Terms of Service for Abloom - Couples Questions

IMPORTANT: By downloading, installing, or using Abloom, you agree to these Terms of Service. Please read them carefully. If you do not agree, do not use the app.
1. Acceptance of Terms
By downloading, installing, accessing, or using the Abloom - Couples Questions mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and Viksva, MB, a company registered in Vilnius, Lithuania ("Company," "we," "our," or "us").
2. Description of Service
Abloom is a mobile application designed to help couples strengthen their relationship through daily questions, shared activities, and communication tools. The App provides:
- Daily couples questions to spark meaningful conversations
- Bonus questions you can send to your partner
- Shared bucket list for planning dreams and goals together
- Important dates calendar for anniversaries and special occasions
- Sticky notes for leaving sweet messages to your partner
- Relationship growth visualization (Bonsai/mascot progress)
- End-to-end encrypted answers for privacy

The App is NOT a substitute for professional relationship counseling, therapy, or mental health services. We do not provide medical, psychological, or therapeutic advice. If you are experiencing serious relationship difficulties, domestic issues, or mental health concerns, please consult qualified professionals. We make no guarantees about relationship outcomes or improvements from using this App.
3. User Accounts and Authentication
- Anonymous Authentication: We use Firebase Anonymous Authentication. You do not need to provide an email address, phone number, or password to use the App.
- Device-Based Identity: Your account is tied to your device. If you uninstall the App or clear its data, you may lose access to your account.
- Deletion Token: Upon account creation, you receive a unique Deletion Token (format: XXXX-XXXX-XXXX). Save this token securely - it allows you to request account deletion if you lose app access.
- Partner Connection: You connect with your partner using an invite code. Once connected, you share a couple account.
4. Subscription Plans and Billing
4.1 Available Subscription Tiers
- Free Tier: Limited access with 3 shared bucket list items, 3 shared important dates
- Weekly Subscription: Includes a 3-day free trial, then weekly billing for full premium access
- Yearly Subscription: Annual billing (no trial) for full premium access at a discounted rate
4.2 Shared Premium
One Subscription Covers Both Partners: When either partner subscribes to Premium, BOTH partners automatically receive full Premium access. Only one subscription is needed per couple. This is tracked at the couple level, not individually.
4.3 Premium Features
- Unlimited bucket list items
- Unlimited important dates
- Bonus questions
- Choice of growth mascot/symbol
4.4 Free Trial Terms
- The weekly subscription includes a 3-day free trial
- Your payment method will be charged automatically when the trial expires unless cancelled beforehand
- The yearly subscription does not include a free trial
4.5 Automatic Renewal
IMPORTANT: All subscriptions automatically renew unless cancelled before the current billing period ends.
- Weekly subscriptions renew every 7 days
- Yearly subscriptions renew every 365 days
- Renewal charges are processed through your App Store or Google Play Store account
5. Subscription Management and Cancellation
5.1 How to Cancel Your Subscription
For iOS (Apple App Store):
- Open the Settings app on your iOS device
- Tap your Apple ID at the top of the screen
- Tap "Subscriptions"
- Find "Abloom" and tap it
- Tap "Cancel Subscription"
For Android (Google Play Store):
- Open the Google Play Store app
- Tap the profile icon in the top right
- Tap "Payments & subscriptions" then "Subscriptions"
- Find "Abloom" and tap it
- Tap "Cancel subscription"
5.2 Refunds
REFUND POLICY:
- All payments are processed by Apple App Store or Google Play Store, not by us directly
- We do not have the ability to process refunds
- For refund requests, contact the respective app store:
- Apple: Visit reportaproblem.apple.com
- Google: Request through Google Play Store support
- You can cancel during the 3-day free trial (weekly subscription) to avoid charges
6. User Responsibilities
6.1 Acceptable Use
You agree to:
- Use the App only for lawful purposes
- Keep your deletion token secure
- Use the App only with your actual romantic partner
- Maintain respectful communication with your partner
- Not share your couple's private answers with others
6.2 Prohibited Activities
You may not:
- Use the App for any illegal or unauthorized purpose
- Reverse engineer, decompile, or disassemble the App
- Share your subscription access outside your relationship
- Attempt to circumvent usage limitations or security measures
- Use the App in a way that could damage or impair our services
- Submit inappropriate, offensive, or harmful content
- Attempt to gain unauthorized access to our systems
- Use the App if you are under 13 years of age
7. Privacy and Data
Your privacy is important to us. Please review our Privacy Policy for details on how we collect, use, and protect your data.
Key Points:
- Answers are encrypted end-to-end using AES-256-CBC
- We cannot read your encrypted answers
- Only you and your partner can decrypt and view answers
- Encrypted answers are deleted from our servers after both partners sync
- Decrypted answers remain only on your local devices
8. Intellectual Property
The App, including all content, features, questions, graphics, and functionality, is owned by Viksva, MB and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes only.
9. Third-Party Services
The App integrates with third-party services including:
- Firebase (authentication, database, cloud functions, push notifications)
- RevenueCat (subscription management)
- Apple App Store and Google Play Store (payment processing)
These third parties have their own terms of service and privacy policies. We are not responsible for their practices.
10. Disclaimers and Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
- The App is provided "AS IS" and "AS AVAILABLE" without warranties of any kind
- We do not guarantee the App will meet your requirements or expectations
- We do not guarantee uninterrupted, error-free, or secure service
- We are NOT responsible for any relationship outcomes, decisions, or consequences arising from use of this App
- We are NOT liable for any data loss, sync issues, or technical problems
- We are NOT responsible for any decisions made based on questions or content in the App
- We are NOT providing therapy, counseling, or professional advice
- Our total liability is limited to the amount you paid for the service in the 12 months preceding any claim
- We shall not be liable for any indirect, incidental, special, or consequential damages
11. Indemnification
You agree to indemnify and hold harmless Viksva, MB, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any rights of another party
- Any content you submit through the App
- Any relationship decisions or outcomes related to App use
12. Service Modifications and Termination
- We reserve the right to modify, suspend, or discontinue the App at any time
- We may update the App to improve functionality or security
- We may terminate your access for violation of these Terms
- Upon termination, subscription billing continues until cancelled through your app store
13. Changes to Terms
AMENDMENTS: We reserve the right to modify these Terms at any time. We will update the "Last Updated" date when changes are made. Your continued use of the App after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
14. Governing Law
- These Terms are governed by the laws of Lithuania
- Any disputes shall be resolved exclusively in the courts of Lithuania
- You consent to the jurisdiction of Lithuanian courts
15. App Store Terms
15.1 Apple App Store
For iOS users:
- These Terms are between you and Viksva, MB, not Apple Inc.
- Apple is not responsible for the App or its content
- Apple has no obligation to provide support for the App
- Apple is a third-party beneficiary of these Terms
15.2 Google Play Store
For Android users:
- These Terms are between you and Viksva, MB, not Google LLC
- Google is not responsible for the App or its content
- Google has no obligation to provide support for the App

17. Severability
If any provision of these Terms is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Viksva, MB regarding use of the App.
